Tavira Terms of Use

Tavira is a business-to-business inventory service. These Terms govern authorized field-user conduct. A separate customer agreement between GDK Digital LLC and your organization governs the subscription, customer workspace, commercial terms, and processing of organization-controlled data. If that agreement conflicts with these Terms, the customer agreement controls for the customer relationship and hosted service.
These Terms of Use and Acceptable Use Rules ("Terms") apply when you access or use Tavira, including the hosted web service, API-connected features, and iOS or Android field apps (together, the "Service"). Tavira is provided by GDK Digital LLC ("GDK Digital," "we," "us," or "our") to customer organizations and their authorized users.
You may use the Service only through an organization that has authorized your access. By signing in to or using the Service after receiving these Terms, you agree to follow these user rules. If you do not agree, do not use the Service and contact your organization administrator.
1. Organization Accounts and Authority
Your organization controls who may access its Tavira workspace, which roles and permissions users receive, and the business purposes for which its workspace is used. You must:
- use only the account assigned to you and provide accurate account information;
- keep passwords, authentication codes, sessions, and devices secure;
- use only the organizations, locations, records, and functions that you are authorized to access;
- promptly report suspected unauthorized access to your organization administrator and Tavira support; and
- follow your organization's policies, instructions, and applicable law.
Your account is individual to you unless GDK Digital and your organization expressly approve another arrangement. You may not share credentials or allow another person to use your authenticated session.
2. Customer Agreement and Document Roles
The organization-level agreement may include an order form, master or subscription agreement, data processing addendum, security exhibit, and support or service schedule. Those documents allocate commercial, privacy, security, retention, and operational responsibilities between GDK Digital and the customer organization. These public Terms do not change pricing, service levels, data residency, retention periods, security certifications, warranties, liability allocation, or other negotiated customer terms.
If no signed customer agreement addresses a specific field-user conduct issue, these Terms apply to that issue to the fullest extent permitted by law. The Tavira Privacy Policy controls on privacy notice matters. Applicable app-store terms control distribution of the installed mobile software.
3. Permitted Use
You may use Tavira for authorized business inventory and field operations, such as viewing and updating inventory, scanning labels, documenting item condition, recording custody or job information, working offline when supported, and using organization-enabled assistance features.
You are responsible for the accuracy and appropriateness of information you enter and for independently checking records before relying on them for safety-critical, financial, contractual, legal, regulatory, or professional decisions.
4. Prohibited Use
You must not use or attempt to use the Service to:
- access another user, organization, tenant, workspace, device, or record without authorization;
- evade permissions, authentication, tenant boundaries, usage controls, or security measures;
- probe, scan, penetration test, reverse engineer, decompile, scrape, or disrupt the Service except under a written authorization from GDK Digital;
- introduce malware, destructive code, excessive automated traffic, denial-of-service activity, or fraudulent data;
- use the Service for unlawful, abusive, deceptive, harassing, discriminatory, infringing, or dangerous activity;
- misrepresent inventory, custody, work completion, identity, authority, or Service output;
- submit data you are not authorized to provide, including another person's confidential information;
- upload payment-card data, government identification numbers, medical records, biometric templates, authentication secrets, or similarly sensitive data unless the customer agreement and your organization expressly authorize that data type;
- sell, sublicense, rent, or make your access available to an unauthorized third party; or
- remove proprietary notices or use GDK Digital trademarks without permission.
5. Customer Data and User Content
The customer organization or other applicable rights holder retains its rights in inventory, custody, job, location, note, photo, and other content submitted to the Service. GDK Digital processes organization-controlled content to provide, secure, support, and improve the Service as described in the customer agreement and Privacy Policy.
You must have authorization to create, view, change, synchronize, export, or delete content. You must not use personal data or confidential information outside the purpose for which your organization provided access. Account deletion does not automatically erase organization-controlled operational records that the organization is entitled or required to retain.
6. Mobile Devices, Permissions, and Offline Work
The mobile field apps may use camera access for barcode or QR scanning and item photos, photo-library access for images you select, device-provided biometric authentication results, local notifications, secure credential storage, and a local offline data cache. Available functions depend on your device, permissions, role, organization settings, and connectivity.
You are responsible for securing the device, installing supported updates, reporting a lost or compromised device, and allowing queued changes to synchronize before repeating an operation. Offline status, delayed synchronization, conflicting edits, damaged labels, and device conditions can affect displayed information. Verify that important work has synchronized and that the current server record reflects the intended result.
7. AI-Assisted Features
If your organization enables an AI-assisted feature, it may use your query and relevant inventory context to provide search or read-only assistance as described in the Privacy Policy. AI output can be incomplete, inaccurate, or out of date. It is not a substitute for a physical count, authorized system record, professional judgment, legal advice, safety review, or regulatory determination.
- Do not include secrets or sensitive personal, regulated, or customer information beyond what your organization has authorized for the feature.
- Verify the underlying Tavira records and real-world conditions before acting on an answer.
- Do not use AI output as the sole basis for a safety-critical, employment, credit, insurance, legal, financial, regulatory, or similarly significant decision.
8. Service and Record Limitations
Tavira is a workflow and recordkeeping aid. It does not guarantee that an inventory count, custody chain, scan result, location, photo, offline queue, synchronization result, or AI response matches physical conditions. Authorized users and customer organizations remain responsible for physical verification, worksite safety, required inspections, reconciliations, approvals, and compliance obligations.
Features may change, be unavailable, or require maintenance. Any binding support target, service level, warranty, credit, or business-continuity commitment exists only if it appears in the applicable customer agreement.
9. Privacy, Security, and Support
Our Tavira Privacy Policy describes relevant data categories, purposes, recipients, permissions, retention criteria, choices, and rights. Use the Tavira Support page for product help or security concerns. Do not send passwords, authentication codes, API keys, or confidential inventory data through the public support form.
You can start an individual account-deletion request inside the mobile app or through the public deletion page. Your organization may need to address access changes or organization-controlled records.
10. Suspension and Termination
Your organization may change or revoke your access. GDK Digital may limit, suspend, or terminate access when reasonably necessary to protect the Service or another person, investigate suspected misuse, comply with law or an app-store requirement, address nonpayment or termination under the customer agreement, or enforce these Terms. Where appropriate, GDK Digital will coordinate organization-user issues with the customer administrator.
When access ends, stop using the Service and remove locally stored organization data as directed by your organization. Sections that by their nature should continue, including ownership, restrictions, disclaimers, and document precedence, survive termination.
11. App Store Terms
The Tavira mobile apps are field clients for the hosted Service. They are not separate customer subscriptions.
If you obtain Tavira from Apple's App Store, Apple's Standard Licensed Application End User License Agreement applies to the licensed iOS application unless App Store Connect displays a different license. Apple is not responsible for Tavira support or the hosted Service.
If you obtain Tavira from Google Play, the Google Play terms and distribution license apply to the Android application. Google is not a party to the customer agreement and is not responsible for Tavira support or the hosted Service.
The applicable store terms govern distribution and use of the installed app. The customer agreement governs the hosted Tavira subscription, organization workspace, and customer-directed data.
12. Intellectual Property and Feedback
Tavira's software, interfaces, documentation, branding, and service technology are owned by GDK Digital or its licensors. These Terms grant only a limited, revocable right to use the Service while you remain an authorized user. No ownership right is transferred.
Open-source and third-party software attribution for the mobile field apps is available in the Tavira Third-Party Notices.
If you voluntarily provide a suggestion or feedback, GDK Digital may use it without restriction or payment, but we will handle personal information contained in support communications under the Privacy Policy. Do not submit an idea you are not authorized to share.
13. Disclaimers and Responsibility
To the fullest extent permitted by law and subject to the controlling customer agreement, the Service is provided "as is" and "as available." GDK Digital disclaims implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or suitable as the sole record for a particular operational, safety, legal, or regulatory purpose.
Liability between GDK Digital and the customer organization is governed by the customer agreement. Nothing in these Terms excludes a right or liability that cannot lawfully be excluded. These Terms do not make an individual field user responsible for the customer's subscription fees or negotiated commercial obligations.
14. Governing Terms and Changes
Except where a customer agreement or mandatory law provides otherwise, these Terms are governed by Michigan law without regard to conflict-of-law rules. Any customer dispute process, governing law, venue, or notice clause in the customer agreement controls for that customer relationship.
We may update these Terms to reflect Service, legal, security, or operational changes. We will revise the date above and provide notice through the Service, an organization administrator, or another reasonable channel when a change is material. Changes apply prospectively. If your organization or you cannot accept a material update, stop using the Service and contact the organization administrator.
