These Terms of Service ("Terms") govern your access to and use of the Pitch Please mobile application and its features, content, and related services (together, the "App"). Pitch Please is published by GDK Digital LLC and distributed through the Apple App Store and Google Play.

By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not install or use the App.

The companion End User License Agreement (EULA) governs the software license for the App and is incorporated into these Terms by reference. If a direct conflict arises on a licensing matter, the EULA controls for that matter.

1. The App and What It Does

Pitch Please is a measurement aid that estimates roof pitch (slope) using your device's built-in motion sensors and an optional camera alignment view. It presents readings as a pitch ratio (for example, X:12) and in degrees, and lets you save a photo or screenshot of a reading to your own device.

The App's measurement modes run on iOS and Android in landscape orientation. The settings screen may be used in portrait or landscape.

• Direct Mode: You place or hold the device along the roof surface and read the pitch on screen. A button saves a screenshot of the reading.
• Camera Mode: The camera preview shows an alignment guide and live pitch overlay. The shutter saves a photo with the alignment line, pitch, and degree values shown on it.

The App also includes calibration, settings, and a built-in help guide.

2. Estimation Tool Only

• Readings are estimates and depend on device hardware, sensor calibration, device position, surface conditions, temperature, and other factors.
• The App is not the final authority for any roof's pitch, slope, dimensions, condition, or suitability.
• You must independently verify readings before relying on them for cost, safety, contracts, permits, code compliance, insurance, structural work, material ordering, or anyone's wellbeing.
• Do not rely on the App as the sole basis for any safety-critical, structural, legal, financial, regulatory, or professional decision.
• Saved photos and screenshots are for your own reference and are not certified, professional, or authoritative measurements.

If you are not willing to treat App readings as non-authoritative estimates that you verify independently, do not use the App.

3. Safety

Measuring a roof can involve working at height and around hazards. The App does not make any task safe and does not reduce the risks of your physical environment.

• You are solely responsible for your own physical safety and the safety of others while using the App.
• You will follow applicable safety practices, laws, regulations, and manufacturer guidance for any ladder, equipment, or worksite.
• You will not use the App in a way that distracts you from hazards or substitutes for proper fall protection, supervision, or professional services.
• You will not use the App while operating a vehicle or in any other situation where attention to the device would be unsafe.

GDK Digital is not responsible for any injury, death, property damage, or loss arising from physical activity associated with using or attempting to use the App.

4. Eligibility and License

You may use the App only if you can form a binding contract with GDK Digital and are not barred from doing so under applicable law. If you use the App on behalf of an organization, you represent that you are authorized to accept these Terms for that organization.

The App is a general-utility tool and is not directed to children. The App does not collect personal information from anyone, including children.

Your right to install and use the App is a license, not a sale, and is granted under the EULA.

5. Permissions, Privacy, and Content

The App requests only the device permissions it needs to function. You can grant or deny these in your device settings and change them at any time.

• Camera: Used only for Camera Mode preview, alignment guide, pitch overlay, and photos you choose to capture. The App does not record audio or video and does not request microphone access.
• Motion / device sensors: Used to calculate pitch on your device in real time.
• Save photos to your library: Used only to save a photo or screenshot that you choose to capture. The App requests add/save-only access and does not request permission to read, browse, or access your existing photos.
• Haptic feedback: If enabled, the App may use your device's vibration or haptic motor to confirm actions such as saving a photo or screenshot, switching modes, or completing calibration.
• Keep Screen On: If enabled, the App may temporarily keep your display awake while Direct Mode is open.

The App does not request location, contacts, microphone, broad storage/media-read access, or background activity permissions.

GDK Digital designed Pitch Please to operate without collecting your personal data. The App has no account, no analytics, no advertising, no tracking, no third-party data SDKs, and no server that receives your readings, photos, or usage. Settings and calibration are stored locally on your device. Photos and screenshots you capture are saved to your own device photo library. The separate Privacy Policy controls on privacy matters.

6. Acceptable Use and Intellectual Property

You agree that you will not use the App unlawfully, use App output as an authoritative measurement without independent verification, reverse engineer or modify the App except where applicable law permits, interfere with security or functionality, misrepresent App output as certified or guaranteed, or remove proprietary notices.

The App, including its software, design, interface, logos, brand assets, text, and graphics, is owned by GDK Digital or its licensors. These Terms do not grant you ownership rights. Photos and screenshots you create using the App are yours; GDK Digital claims no ownership over them.

7. Purchases and App Stores

Pitch Please may be offered free of charge and/or as a paid app. Any price, purchase, billing, payment, and refund for the App are handled by the app store from which you obtained it, not by GDK Digital directly. Purchases and refunds are subject to the applicable app store's terms, billing rules, and refund policies. A free or beta period does not guarantee continued free availability.

8. Apple and Google Terms

These Terms are between you and GDK Digital, not Apple or Google. The applicable app store's terms also apply.

If you obtained the App from Apple, the license is non-transferable and limited to Apple-branded products you own or control, as permitted by the Apple Media Services Terms and Conditions. The license also permits access and use by other accounts associated with you through Apple Family Sharing or volume purchasing, to the extent permitted by Apple's Usage Rules and the App Store distribution model. Apple has no maintenance or support obligation for the App, no warranty obligation beyond any App Store refund process, and is a third-party beneficiary of these Terms.

If you obtained the App from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the App.

9. Updates, Disclaimers, and Liability

GDK Digital may update, modify, suspend, or discontinue the App or any feature at any time. We are not obligated to provide updates or maintain compatibility with every device or OS version.

To the fullest extent permitted by applicable law, the App is provided "as is" and "as available," without warranties of any kind, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. GDK Digital does not warrant that the App's readings are accurate, reliable, complete, or suitable for any particular purpose.

To the fullest extent permitted by applicable law, GDK Digital and its owners, personnel, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, data, goodwill, or business, or for damage, cost, rework, material waste, contract dispute, regulatory issue, injury, or loss resulting from an inaccurate or misused measurement or any decision based on the App. GDK Digital's total aggregate liability for all App-related claims will not exceed the greater of the amount you paid for the App in the twelve months before the claim or USD $100.00.

Nothing in these Terms limits rights or liabilities that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence, fraud, or mandatory consumer-protection rights.

10. Indemnification and Termination

To the extent permitted by applicable law, you agree to indemnify and hold harmless GDK Digital and its owners, personnel, and licensors from third-party claims and reasonable related costs arising from your unlawful use of the App, violation of law, infringement of third-party rights, or presentation of an App reading as a certified, professional, or authoritative measurement.

These Terms apply for as long as you use the App. You may stop using the App and uninstall it at any time. GDK Digital may suspend or terminate your license if you materially breach these Terms or the EULA, or as required by law or app-store policy.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict-of-laws rules, except where mandatory consumer-protection law provides otherwise. Before filing a formal claim, you agree to contact GDK Digital and attempt in good faith to resolve the dispute informally for at least 30 days. If unresolved, disputes will be subject to the exclusive jurisdiction of the state and federal courts located in Michigan, except that either party may seek injunctive relief in any court of competent jurisdiction, and except where applicable law gives you the right to bring proceedings in your local courts.

12. Changes and General Terms

GDK Digital may update these Terms from time to time. Material changes apply going forward only, and we will update the "Last updated" date, make the revised Terms available through the App and/or this page, and provide reasonable in-app notice. Continued use after updated Terms take effect, following such notice, constitutes acceptance.

These Terms, together with the EULA and Privacy Policy, are the entire agreement between you and GDK Digital regarding the App. If any provision is found unenforceable, the rest remains in effect. GDK Digital's failure to enforce a provision is not a waiver. You may not assign these Terms without GDK Digital's consent. GDK Digital may assign them in connection with a merger, acquisition, or sale of assets.
